Published Cases of Weinstein & Douglas, P.C

At Weinstein & Douglas, P.C., we strive to produce exceptional results for our clients. Sometimes that means exploring new areas of the law. In a majority of cases we are able to use existing case law to protect the interests of our clients. However, when necessary and when possible, we use our understanding of personal injury, criminal, family, and civil law to produce results that create new case law. A few of our published cases include:

People v. Hunter, 298 Ill.App.3d 126, 232 Ill.Dec. 392, 698 N.E.2d 230 (2nd Dist 1998), appeal denied, 179 Ill.2d 601, 235 Ill.Dec. 571, 705 N.E.2d 444 (1998).

The trial court dismissed an indictment, on the defendant’s motion, because the indictment was based upon false testimony. The State presented new testimony, a second indictment was returned, which was also dismissed on the defendant’s motion. The State appealed.

The Appellate Court found that if the State presents perjured testimony before a Grand Jury to secure the return of an indictment, a defendant’s due process rights are violated, and such an indictment must be dismissed, without an ability to reindict.

Vorpagel v. Maxell Corp. of America, 333 Ill.App.3d 51, 266 Ill.Dec. 818, 775 N.E.2d 658 (2nd Dist. 2002), appeal denied, 202 Ill.2d 664, 272 Ill.Dec. 355, 787 N.E.2d 170 (2002).

An employee brought a retaliatory discharge action against his former employer, after he was fired for reporting incriminating statements made by a supervisor about a sexual relationship with the supervisor's minor daughter. The Circuit Court, dismissed the complaint, and the employee appealed.

The Appellate Court found that an employee could maintain a retaliatory discharge claim against his employer even though the criminal conduct being investigated was nonwork-related.
